These terms and conditions, and the documents referred to herein, are intended to contain all the terms of any agreement between us and you (as the purchaser) relating to the sale and purchase of a Used Vehicle (UV) from our UV-stock at any given time (the “Goods”).
Please note that any reference to us, we or ours in this Agreement refers to Hexagon Leasing Limited. If you wish to rely on any amendment or addition, you should ensure it is confirmed in writing by one of our duly authorised representatives. If we agree any variation in the Goods to be supplied, this shall be deemed to be an amendment to these terms and conditions rather than a new agreement.
You must provide us with any information we need to comply with money laundering or any other tax or compliance legislation and by doing so, guarantee the accuracy of the information so supplied.
Purchase Price
You will be advised in writing the Purchase Price of the Goods. You will also be advised if the sale of the Goods is a “Retail” or “Trade/Sold As Seen” sale. This will also be confirmed on your invoice from us to you.
A “Retail” sale may include a purchasable warranty sold to you via a third-party at arm’s length by us with all claims, terms and conditions under such warranty to be claimed from them and not us.
“Trade/Sold As Seen” purchases are not sold with and shall not carry or have any warranty given or implied. You will be totally responsible and satisfied with the vehicle’s condition, performance and all other items prior to payment and collection of the Goods on or for a “Trade/Sold As Seen” sale.
The Purchase Price for the Goods, including where applicable accessories, shall be exclusive of VAT. VAT will be charged at the current rate at the date of final invoicing. Payment for any vehicle, irrespective of if sold “Retail” or “Trade/Sold As Seen”, must be made in full before the collection of the Goods.
Collection
Whilst we will endeavour to make the Goods available by the estimated collection date, we will not be liable for any claim for compensation of any description arising out of a delay in the collection date under any circumstances. In the event of such a delay, we will contact you to agree an alternative collection date.
We will inform you when the Goods are ready for collection, and you must pay the Purchase Price and collect the Goods within 14 days of being so informed. All payments must be made to us in advance of such collection.
Transfer of Ownership and Risk
The Goods will continue to belong to us until the total Purchase Price has been paid by you in full. You will be responsible for any loss or damage from when the Goods are collected by you, and you should insure accordingly.
Warranty
No warranty is given or implied on the sale of any goods. If the Goods are sold as a “Retail” sale, you will be given the opportunity to purchase an arms-length warranty provided by a third party. Full details of the warranty will be provided to you under separate cover.
“Trade/Sold As Seen” purchases are not sold with and shall not carry or have any warranty given or implied in all and every circumstance(s).
Distance Selling and Off-Premises Contracts
We do not sell vehicles to the general public, sole traders or partnerships.
Consent and Marketing
- If you are an existing customer prior to May 25th 2018 and have not opted out of receiving communications from us, we may contact you from time to time for marketing purposes with relevant communications about our products and services.
- If you are a new customer to us after May 25th 2018 or an existing customer after May 25th 2018, and have opted in to receive communications from us, we may contact you from time to time for marketing and other purposes via the channels you have opted in to.
- In all cases, you have the right at any time free of charge to update these preferences and opt into or out of marketing by contacting us.
Governing Law and Jurisdiction
- These terms and conditions shall be governed by the laws of England, and the parties submit to the exclusive jurisdiction of the Courts of England.
